Constitutional Court rejects application for annulment of Flemish kilometre charge decree

In a decision dated 23 February 2017, the Constitutional Court rejected an application for annulment of the Decree of the Flemish Region of 3 July 2015 introducing the kilometre charge.

The Court ruled, among other things, that the kilometre charge was in accordance with the principle of equality in also charging unloaded vehicles, since unloaded vehicles also contribute to creating the costs which the kilometre charge is specifically intended to absorb.
