Some 80 participants attended our Legal Compliance & Risk Management Seminar on 4 June 2019  introduced by Marieke Wyckaert (Partner, Eubelius) and the panel session (moderated by David Szafran, Counsel at Eubelius) with high level experts Rodrigo Cunha (Global Ethics & Legal Director, AB InBev), Mathieu Maes (Compliance Pro Register and Secretary General of ICC Belgium), Carlos De Smet (Visiting Lecturer, UCLouvain) and Jean-Marc Gollier (Senior Counsel, Eubelius).

Panel moderator David Szafran also addressed the new directors’ liability regime under the new Code of Companies and Associations, case law related to compliance and the application of internationally recognised standards in relation to compliance and risk management, and presented the results of a compliance survey conducted in May 2019.

The survey reveals, among other things, that, of  49 companies of all sizes – listed and unlisted – which participated:

  1. less than half have an internal process to manage conflicts of interest;
  2. about one-third of companies with export activities screen existing contracts against sanctioned parties lists;
  3. one-quarter of companies do not screen agreements (if any) with competitors against competition rules;
  4. nearly one-third transfer personal data outside the EU.

Failure to comply with legal requirements can affect the business continuity of a company. It can also trigger civil and criminal liability of the company, its directors and management.
